Welcome to Verbalyze. These Terms of Service (“Terms”) govern your use of the Verbalyze mobile application (the “App”) operated by Verbalyze (“we,” “our,” or “us”).

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

2. App Description and Limitations
2.1 App Purpose
Verbalyze is a private, AI-powered chat companion that supports personal growth and emotional wellbeing through secure conversations.

2.2 Non-Medical Nature
The App is not intended to provide medical advice, diagnosis, or treatment. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

The AI companions in the App are not licensed medical professionals, therapists, or counselors. They provide conversational support only and should never be used in place of professional healthcare services, especially in emergency situations.

3. User Accounts
To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. User Conduct
4.1 Prohibited Activities
You agree not to use the App:

In any way that violates any applicable federal, state, local, or international law or regulation
To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation
To impersonate or attempt to impersonate us, our employees, another user, or any other person or entity
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which may harm us or users of the App or expose them to liability
4.2 Prohibited Content
You agree not to input or upload content that:

Is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, or harmful to minors
Promotes illegal activities or self-harm
Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of the App
5. Intellectual Property
5.1 App Content
The App and its original content, features, and functionality are and will remain the exclusive property of us and our licensors. The App is protected by copyright, trademark, and other laws.

5.2 User Content
By submitting content to the App (including chat messages), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the service provided by the App.

6. Data Collection and Privacy
6.1 Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

6.2 Data Security
We implement reasonable security measures to protect your personal information:

Chat messages are encrypted before storage
Authentication tokens are securely stored
Regular security audits are conducted to ensure data protection
However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security
6.3 App Store Compliance
Our privacy practices comply with all applicable laws and the requirements set by the Apple App Store and Google Play Store. We do not collect more data than is necessary to provide our services, and we do not sell your personal information to third parties.

7.2 Authentication and Storage
The App uses Supabase for authentication and database services. Your use of these services is subject to their respective terms of service and privacy policies.

8. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will function without interruption or errors, that defects will be corrected, or that the App is free of viruses or other harmful components.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP.

10. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App.

11. Changes to Terms
We may revise these Terms at any time by updating this page. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms.

12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law principles.
